Welcome to TutorPortal. By registering an account, utilizing our software dashboard, or interacting with our invoicing and client portal links, you agree to be bound legally by these Terms of Service. If you do not agree, you must immediately cease using the platform.
1. The "Software Only" Limited Liability Clause
TutorPortal is strictly an administrative management software provider. The Platform is designed as a standalone digital operating utility to log hours, track clients, and facilitate communication links.
- TutorPortal is not a tutoring agency, company, or employer.
- Independent tutors utilizing this application are standalone service providers and are not employees, agents, or contractors of TutorPortal.
- TutorPortal acts entirely as a neutral platform utility and is not a party to, nor liable for, any educational, structural, schedule, behavioral, or financial disputes arising between an independent tutor and a parent or guardian.
2. Client Portals and Public "As-Is" Calendars
The platform provides shared, public-facing, read-only "Client Views" designed to give transparency to parents regarding historical and upcoming lessons.
- The content displayed on these portals represents raw data uploaded directly by the independent tutor. TutorPortal does not manually audit, confirm, or verify the validity of logged session durations or subjects.
- Any discrepancies noticed within a client portal schedule must be raised directly with the independent tutor. TutorPortal is not liable for incorrect, missing, or fraudulent dashboard inputs introduced by database operators.
3. The 5% Convenience Fee Split-Revenue Disclaimer
- TutorPortal is completely free for independent tutors to utilize for scheduling, logs, and client management.
- To fund our transactional infrastructure, hosting capabilities, and payment security pipelines, a flat 5% platform convenience fee is systematically appended to the invoice total on both the direct checkout links and the Client Portal settlement gateways.
- By utilizing TutorPortal to generate billing requests or using the integrated checkout options, the user explicitly acknowledges and agrees to this convenience fee allocation.
4. Strict Minor Consent Protocol (Under 18 Learners)
POPIA treats the personal information of children with extreme sensitivity.
- By manually capturing or logging any student information (including names, grades, or lesson records) belonging to a minor under the age of 18, the Tutor warrants, represents, and legally guarantees that they have obtained the explicit, lawful, and prior consent of that child's parent or legal guardian to do so, including consent for exposure on secure read-only Client Views.
- The Tutor agrees to indemnify TutorPortal against any legal actions, claims, or data disputes resulting from a failure to secure proper parental consent.
5. Account Deletion & System Disclaimers
Users may close their workspaces at any time. TutorPortal reserves the right to terminate access for users violating data boundaries or manipulating system transaction loops. While we maintain a 99% cloud architecture uptime target, TutorPortal provides its software on an "as-is" basis and is not liable for indirect revenue loss resulting from periodic cloud hosting disruptions.
