Terms of Service

Welcome to TutorPortal. By registering an account, utilizing our software dashboard, or interacting with our invoicing and client portal links, you agree to be bound legally by these Terms of Service. If you do not agree, you must immediately cease using the platform.

1. The "Software Only" Limited Liability Clause

TutorPortal is strictly an administrative management software provider. The Platform is designed as a standalone digital operating utility to log hours, track clients, and facilitate communication links.

  • TutorPortal is not a tutoring agency, company, or employer.
  • Independent tutors utilizing this application are standalone service providers and are not employees, agents, or contractors of TutorPortal.
  • TutorPortal acts entirely as a neutral platform utility and is not a party to, nor liable for, any educational, structural, schedule, behavioral, or financial disputes arising between an independent tutor and a parent or guardian.

2. Client Portals and Public "As-Is" Calendars

The platform provides shared, public-facing, read-only "Client Views" designed to give transparency to parents regarding historical and upcoming lessons.

  • The content displayed on these portals represents raw data uploaded directly by the independent tutor. TutorPortal does not manually audit, confirm, or verify the validity of logged session durations or subjects.
  • Any discrepancies noticed within a client portal schedule must be raised directly with the independent tutor. TutorPortal is not liable for incorrect, missing, or fraudulent dashboard inputs introduced by database operators.

3. Pricing, Convenience Fees, and Transaction Structures

  • TutorPortal provides its core scheduling and administrative tools to independent tutors.
  • To fund our transactional infrastructure, hosting capabilities, and payment security pipelines, processing fees or platform service adjustments are calculated dynamically based on the tutor's configured billing preferences (either absorbed by the merchant or passed securely to the client via our payment gateway checkout).
  • By utilizing TutorPortal to generate billing requests or using the integrated checkout options, the user explicitly acknowledges and agrees to the final calculated pricing displayed at checkout.
  • Fee Modifications: TutorPortal reserves the right to modify, update, or adjust its pricing models, convenience fees, or subscription structures at any time. Users will be notified of any material changes to our fee structures via email or platform notification at least fourteen (14) days prior to the changes taking effect. Continued use of the platform after the notice period constitutes acceptance of the updated pricing.

4. Refund, Cancellation, and Dispute Policy

Because TutorPortal functions as a software provider facilitating direct settlement to independent tutors and agencies:

  • Session Cancellations: Any lesson rescheduling or cancellation requests must be communicated directly to the respective independent tutor or agency according to their individual cancellation windows (typically 24 hours prior to a scheduled session).
  • Refund Requests: Payments processed through our checkout gateway are routed directly to the designated tutor or agency subaccount. TutorPortal does not hold merchant funds as a principal. Therefore, all refund requests for rendered or unrendered tutoring services must be resolved directly with the independent tutor or agency providing the education. In the event of an approved refund, the tutor or agency is responsible for initiating the reimbursement.
  • Chargebacks & Payment Disputes: Unauthorized card use or transaction disputes must be reported immediately. TutorPortal will cooperate with payment processors (Paystack) and banking institutions to investigate fraudulent claims, but ultimate liability for service delivery rests with the service provider.

5. Strict Minor Consent Protocol (Under 18 Learners)

POPIA treats the personal information of children with extreme sensitivity.

  • By manually capturing or logging any student information (including names, grades, lesson records, or personal contact numbers) belonging to a minor under the age of 18, the Tutor warrants, represents, and legally guarantees that they have obtained the explicit, lawful, and prior consent of that child's parent or legal guardian to do so, including consent for direct onboarding messaging and exposure on secure read-only Client Views.
  • The Tutor agrees to indemnify TutorPortal against any legal actions, claims, or data disputes resulting from a failure to secure proper parental consent.

6. Account Deletion & System Disclaimers

Users may close their workspaces at any time. Terminating an account triggers a permanent cascading deletion, which instantly and irreversibly purges all associated historical data, student records, and session logs from our active databases. TutorPortal reserves the right to terminate access for users violating data boundaries or manipulating system transaction loops. While we maintain a 99% cloud architecture uptime target, TutorPortal provides its software on an "as-is" basis and is not liable for indirect revenue loss resulting from periodic cloud hosting disruptions.

7. Administrative Oversight & Interventions

To maintain platform integrity and provide technical support, authorized TutorPortal system administrators retain the capability to access a master directory of platform accounts. Administrators reserve the right to manually override account configurations, trigger password resets, adjust default agency billing rates, or remove accounts entirely if an operational disruption or terms violation is detected.
